Terms of Service

1. Agreement

These Terms of Service govern your use of the OPEN MINDED platform at openmindedlab.com (the “Service”), operated by OPENMINDED. By creating an account or using the Service you agree to these Terms and to the Privacy Policy and User Content Terms, which are part of these Terms.

2. Eligibility and accounts

You must be at least 18 years old to create an account or use the Service. You are responsible for your account: keep your password confidential, keep your email address current (it is how we verify and contact you), and tell us about any unauthorized use. You may not share an account or use another person’s account.

3. What the Service is

The Service currently provides:

  • market intelligence surfaces — versioned analytical assessments, forecasts and related research published by our separate analysis systems;
  • research and educational content written by the platform;
  • charting tools with client-side visualization indicators;
  • strategy authoring — you can create declarative trading strategies that our separate execution platform evaluates in simulation (“paper”) form; the Service does not place real orders for you;
  • community and User Work surfaces where you create and keep your own content (see the User Content Terms);
  • an educational Skill Tree, including official platform curriculum and your own private study work.

Some features are offered as closed betas, enabled per account. Features may change as the platform evolves; material changes to paid features will be reflected in your billing options.

4. Subscriptions and billing

Paid plans are billed as subscriptions through Stripe, our payment processor. Checkout and card entry happen on Stripe’s hosted pages; your card number is handled by Stripe and never passes through or is stored on our servers. We keep the billing records needed to run your subscription (customer and subscription identifiers, plan, status, and billing history).

You can cancel at any time from the billing portal; cancellation stops future renewals and your plan remains active until the end of the paid period. Plan changes are prorated by the payment processor. Except where required otherwise, fees already paid are not refunded; where a refund is warranted we process it through the payment processor.

5. Market information and trading risk

The Service publishes market analysis, forecasts, signals, strategy evaluations and research. All of it is informational and educational. It is not a recommendation to buy or sell any instrument, and it is not personalized investment, financial, legal or tax advice. The regulatory classification of these surfaces is under review by counsel; nothing in the Service should be read as a claim of registration or licensure.

  • Trading foreign exchange involves substantial risk of loss.
  • Past or simulated results do not guarantee future outcomes.
  • Forecasts and signals can be wrong; measurement of their accuracy is ongoing.
  • Market data may be delayed, incomplete, or revised by its sources.
  • Strategy evaluation is simulation only. Simulated performance differs from live trading.

Decisions you make in any market are yours alone.

6. Your content

Content you create on the Service — Skill Tree User Work, community write-ups, strategies, notes, drawings — belongs to you. The User Content Terms set out the narrow permissions we need to host it, what “public” does and does not mean, and what we will never do with it without a separate agreement.

7. Official platform content

Official curriculum, platform research, market intelligence, and platform software are ours or our licensors’. Official Skill Tree curriculum passes a governed publication process and is labeled by its assurance state; user-created content never becomes official content merely by existing or by being made public. We grant you a personal, non-transferable right to use the Service and its content for your own non-commercial use while these Terms apply. You may not scrape, resell, or republish platform content without written permission.

8. Acceptable use

You agree not to:

  • break the law or infringe others’ rights on the Service;
  • probe, overload, or interfere with the Service, its security controls, or other users’ accounts or content;
  • misrepresent user content as platform-certified or official content;
  • use automated means to harvest content or data beyond what the Service deliberately exposes to you;
  • upload content you do not have the right to share (see User Content Terms).

9. Third-party services

The Service depends on third-party providers — payment processing (Stripe), transactional email (Resend), cloud hosting, and market-data sources. Their availability affects ours, and their terms govern your direct relationships with them (for example, Stripe’s checkout).

10. Availability and changes

We work to keep the Service available and backed up, but it is provided without a guarantee of uninterrupted operation. We may change, suspend or discontinue features; where a change materially reduces a paid feature, we will provide notice and the billing options described in section 4.

11. Suspension and termination

You may stop using the Service at any time; section 4 covers your subscription. We may suspend or terminate accounts that violate these Terms, create security or legal risk, or fail payment, with notice where practical. Sections that by their nature survive (your content ownership, disclaimers, liability, disputes) survive termination.

12. Disclaimers

The Service is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Section 5 governs market information specifically.

13. Limitation of liability

To the extent permitted by applicable law, neither party is liable for indirect, incidental, or consequential damages, and our total liability for claims relating to the Service is capped at the amounts you paid for the Service in the twelve months before the claim. Some jurisdictions limit how liability can be limited; where a limitation is not permitted, it applies to the fullest extent that is.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute that must be brought in court will be brought in a court of competent jurisdiction located in the State of New York, subject to any mandatory rights or venue requirements that apply under applicable law. No arbitration clause, class-action waiver, or jury-trial waiver is included; adding any of them would be a deliberate owner decision, and none has been made.

15. Changes to these Terms

We may update these Terms. Each version carries a version number and effective date. For material changes we will give notice (for example by email or an in-product notice) before the new version takes effect; continued use after the effective date constitutes acceptance. The version history is retained so you can see what changed.
